Terms & Conditions

These Terms and Conditions ("Terms") govern your use of shitalheals.in (the "Site") and any booking, consultation, or communication with Shital Gedam ("the Practitioner"). By using the Site or booking a session, you agree to these Terms. If you do not agree, please do not use the Site or book a session.

1. Who this service is for

This Site offers online behaviour therapy and counselling services to individuals seeking support for themselves, or for a child in their care, in relation to neurodevelopmental support (such as Autism Spectrum Disorder, ADHD, or Learning Disability) or general mental wellbeing (such as Anxiety, Depression, Stress, daily functioning, or Sleep Disorders). Where the client is a minor, a parent or legal guardian must book, consent, and remain involved as described in the Consent & Telehealth Policy.

2. Nature of the service

Services are delivered entirely online by secure video call, WhatsApp, and email, and do not include in-person visits, physical examination, or emergency or crisis care. The Practitioner is a Behaviour Therapist and Counsellor holding a PG in Psychotherapy, Art and Play Therapy, with a specialisation in Applied Behaviour Analysis (ABA), and is not currently registered with the Rehabilitation Council of India (RCI), as stated on the About page. Full detail on scope of practice, consent, and confidentiality is set out in the Consent & Telehealth Policy, which forms part of these Terms.

3. Booking and use of the Site

  • You agree to provide accurate, current information when booking a session, including your name, contact details, and, where relevant, information about the client (for example, a child's age).
  • Bookings are confirmed once the Practitioner responds to your form submission or WhatsApp message with an agreed date and time; a submitted form or message alone does not guarantee a slot.
  • You agree not to use the Site for any unlawful purpose, to misrepresent your identity, or to attempt to disrupt or gain unauthorised access to the Site.

4. Fees and payment

Current session pricing is listed on the Pricing page and is subject to change; the price confirmed at the time of booking applies to that session. Payment terms, methods, and refund conditions are set out in the Cancellation & Refund Policy.

5. No guarantee of outcomes

Behaviour therapy and counselling are collaborative processes, and outcomes depend on many factors outside the Practitioner's control, including consistency of attendance, engagement between sessions, and individual circumstances. The Practitioner does not guarantee any specific result, diagnosis, or improvement, and nothing on this Site should be read as a promise of a particular outcome.

6. Not a substitute for medical or emergency care

This service does not diagnose medical conditions, prescribe medication, or provide emergency or crisis intervention. If you or someone you know is in crisis or at risk of harm, please contact local emergency services or a crisis helpline immediately rather than relying on this Site or a scheduled session. See the Disclaimer for further detail.

7. Intellectual property

All content on this Site, including text, graphics, the logo, and blog articles, is owned by or licensed to Shital Gedam and is provided for your personal, non-commercial use. You may not reproduce, republish, or distribute this content without prior written permission, other than sharing a link to a page for personal or informational purposes.

8. Third-party services

Booking, payment, messaging, and video-call functionality may rely on third-party services (for example, a form-to-email provider, a payment processor, WhatsApp, or a video-calling platform). Your use of those services is also subject to their own terms, and the Practitioner is not responsible for outages, errors, or data-handling practices of third-party providers, beyond what is described in the Privacy Policy.

9. Limitation of liability

To the extent permitted by applicable law, the Practitioner's liability for any claim arising from use of the Site or the services is limited to the amount you actually paid for the session giving rise to the claim. The Practitioner is not liable for indirect, incidental, or consequential loss, or for issues arising from your internet connection, device, or third-party services outside her control.

10. Termination of services

You may stop using this service at any time. The Practitioner may decline to take on a new client, or may discontinue an existing therapeutic relationship, where she believes the service is not appropriate or safe for your situation, in which case a referral will be offered where appropriate.

11. Governing law

These Terms are governed by the laws of India. Any dispute arising from these Terms or the services will be subject to the exclusive jurisdiction of the competent courts in India.

12. Changes to these Terms

These Terms may be updated from time to time; the version in effect at the time of your session or use of the Site applies. Continued use of the Site or the service after an update constitutes acceptance of the revised Terms.
